Having a “License” means using, not owning
The Assets remain protected by copyrights and intellectual property of Stoq or its artists. In other words, you’re purchasing the right to use the Assets. You’re not purchasing the Assets themselves.
Stoqfoto is the owner or the rights holder to license of all the Assets and the Site, inclusive of all copyrights. You do not and will not have any rights whatsoever to the Assets or in the Site, exclusive of the right of use as specified in this License.
This also means that you can’t use the names of the Assets nor of its creator(s) or their artistic name(s), except for giving them credit for their brilliant Asset.
Now that you know what a license is, by using this License, you understand and agree to the rights, obligations, liabilities and prohibitions specified in this License, that you do not and will not have any ownership or intellectual property rights in the Assets and that your rights to the Assets will not exceed the rights described in this License.
You should only use the Assets as a part of your own projects
Simple as it sounds, this means that, as a creator, you should only Incorporate the Assets into your own Projects.
What doesn’t count as your creation?
Reproducing, distributing, re-selling, or any other form, of the Assets as standalone package.
Basically, this License does not allow you to use, make available or present any Assets as a separate file. This means you can’t allow anyone to use the Assets as separate files for viewing, downloading, publicly performing or any other use whatsoever.
This also means you can’t use the Assets to provide any services that compete with Stoq or with any of our artists. You also can’t resell them in any way, such as in video collections, video libraries, video playlists, databases or licensing, etc. You can’t resell and/or upload the Assets or any Projects to stock platforms. This includes not giving the impression that any Assets were created by you.
You can’t use the Assets in any manner which is illegal, contrary to court orders and/or which was forbidden by the provisions of any law. Also, you can’t use the Assets in any manner which may damage Stoq, its artists, any third parties, or their rights or reputation.
The Assets cannot be used: (i) in the context of pornography; or (ii) to encourage violence abomination, racism, hate, threats and discrimination against any person based on race, religion, sex, sexual orientation, community or nationality, (iii) hurting the helpless; (iv) violating privacy; (v) slander and any other insulting or illegal contents.
If the subject of your Project may be reasonably perceived as unflattering or controversial (such as advertisement dealing with sexually transmitted infections), although we have the required releases, you can’t intentionally portray the subject in a negative way and must indicate that the model has no connection to the Project’s content (for example: stating the following: “Stock footage, posed by model”).
Since we understand there might be gray areas in this regard, contact us to explain your project and our team will let you know if this is covered. We reserve to ourselves the right to decide in each case whether a certain use of an Asset is considered a violation of the above, and you undertake to accept our decision in this matter. Don’t worry, we have great professional skills and common sense.
We make our best efforts in order to verify every Asset and make sure they’re great quality and are legally available. However, you know, things happen, and we might find out that a certain Asset might be violating a third party’s rights. Although we have the right to tell you to stop using such Asset, we will do so only in some rare situations. If we do, you must stop using it immediately and do your best to make anyone on your behalf cease the use of such Assets.
Remember we told you that you are not the proprietary owner of the Assets? Well, this also means that you can’t register or claim ownership of the Assets or the Projects (or otherwise make it available) through any content detection and/or registration system, such as YouTube’s Content ID (CID), Facebook Rights Manager, etc.
Provision of this website
You agree that Stoqfoto may stop (permanently or temporarily) providing this website (or any features within this website) to you or to users generally at the Company’s sole discretion, without prior notice to you.
Stoq may make available to you various payment processing methods to facilitate the purchase of digital goods from this website. You agree to abide by any relevant terms of service or other legal agreement, whether with the Company or a third party, that governs your use of a given payment processing method. You agree that the Company reserves the right to add or remove payment processing methods at its sole discretion and without notice to you.
Support
The Company sells and distributes footage as digital goods “as is” and with no implied meaning that they will function exactly as you would like, or that they will be compatible with other third-party software.
Purchases and support for videos and photos sold or distributed by Stoqfoto is only available for those who have a paid license.
Support and updates for our services and products are provided as long as they continue in actively development. Should any one of the following occur, the Company will no longer be responsible for providing support for any service:
- The product in question is no longer actively developed as a viable product under Stoq’s management.
- Stoq is purchased or bought out by another company.
Whilst we attempt to provide the best possible accessibility for our products, we do not guarantee that any particular support query can, or will be answered to the extent, or within a timeframe that the inquirer is completely satisfied.
Warranty
Footage licensed and distributed by the Stoq are done so in the hope that they will be useful, but WITHOUT ANY WARRANTY; without even the implied warranty of MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE.
We do not assume responsibility and will not be held responsible for any conflicts or compatibility issues that may occur due to third-party. We assume no responsibility for trademarks visible in footage and it is the original rightsholders responsibility to handle and distribute content with care. Should conflicts occur with third-party policies or use of trademarks in a way that is malicious for external party that is under the licensed user responsibility.
Product delivery
After process your payment successfully, you will receive an email with your order number and other purchase information. Your login links will also be included in this email. Additionally, you can after ordering a subscription, purchase photots, videos, extended license or other add ons at checkout.
Should you not receive an email containing your information, you can contact us through this page to request your purchase information.
Re-download purchased files will until further count from your monthly credits. Rights of usage is approved for the rightsholder so long as your license key is valid. If a license key expires, download access to the associated files or usage of previously license will be discontinued until such time as the license key is renewed.
Price changes
Prices of all products are subject to change without prior notice or consent.
Refunds policy
Stoqfoto serves the corporate segment and refunds is not offered.
No refunds are allowed for All Access Passes.
Stoq may occasionally send you emails related to the purchase of product(s) from our company. We may also send you occasional email newsletters relating to product updates, updates regarding content that could be relevant to you and the like. We will never sell or release your email to any third party vendors.
Terms of service updates
We reserve the right to modify this terms at any time. We recommend you review this page frequently. If we make material changes to this terms, we may notify you on our website, by a blog post, by email, or by any method we determine. The method we chose is at our sole discretion.
